Where any goods or service requested by you involves a third party, such information as is reasonably necessary by Nuuk to carry out your goods or service request may be shared with such third party and Nuuk may also obtain details and information from the third party on usage. Nuuk may also engage with other entities/ persons to complete services, processing payments, and providing customer service. You understand that such entities/persons may have access to personal information needed to perform their functions.

Additionally, your information may be shared by Nuuk with a third-party business entity in case of any proposed merger, acquisition or re-organization, amalgamation, restructuring of business, or fundraising or any changes in capital structure of the Company.

RETENTION OF USER INFORMATION

Nuuk shall retain your personal information as long as it serves the purpose(s) for which it was initially collected as stated in this Privacy Policy or subsequently authorized. Nuuk may continue processing your personal information for a period and beyond such period only for the time and to the extent such processing reasonably serves the purposes of archiving, and subject to the protection of this Privacy Policy. After the expiry of this time period, Nuuk may either delete your personal information or retain it in a form such that it does not identify you personally.

ALTERATION OF USER INFORMATION

In case the user requests any change or deletion of its information of the user, or permanently delete its account, the user shall contact the data protection and grievance officer. Do note that Nuuk is not obligated to alter or vary or delete any user’s information which it is required to maintain under applicable laws or pursuant to contractual requirements of Nuuk. Any such request shall be made to the Company in written form in accordance with Section 11 (Contact Details) of this Privacy Policy.

DATA BREACH AND DISCLOSURE NOTIFICATION

In the event of a data breach or unauthorized disclosure of user information that poses a high risk to the rights and freedoms of the user, unless Nuuk has effectively mitigated such risks, Nuuk will promptly notify the affected users. The notification will include information about the breach or incident, its consequences, and contact details of the Nuuk’s personnel who can address any inquiries from users regarding the breach. If a governmental or regulatory authority requests Nuuk to provide user information, unless explicitly instructed otherwise by the authority, Nuuk will disclose to the user the details of the request for their user information.

COMMUNICATION

When the user sets up an account or receives any request pursuant to the provision of the services, the user is deemed to have opted in to receive emails and messages from the Company and its service providers in connection with the provision of the services as well as any marketing and promotional agencies. While the user may opt out of promotional messages, the User cannot opt out of receiving certain administrative, financial, technical and legal information from the Company in connection with the services.

MISCESLLANEOUS

You agree and undertake to indemnify Nuuk in any suit or dispute by any third party arising out of disclosure of information by you to third parties through our Platform or otherwise and your use and access of websites, applications and resources of third parties.

Each clause of this Privacy Policy shall be and remain separate from and independent of and severable from all and any other clauses herein, except where otherwise expressly indicated or indicated by the context of the Privacy Policy. The decision or declaration that one or more clauses are null and void shall have no effect on remaining clauses of this Privacy Policy.

Nuuk shall not be liable for any consequential, incidental, special, indirect, exemplary or punitive damages, or damages for any loss of profits, revenue or business, regardless of the nature of the claim.

GOVERNING LAW AND JURISDICTION

The provisions pertaining to governing law and jurisdiction, as specified in the terms and conditions of the Company available at https://nuuk.in/policies/terms-of-service (“Terms and Conditions”), shall apply mutatis mutandis to this Privacy Policy, and shall govern any disputes or claims arising out of or in connection with this Privacy Policy.

SEVERALIBILITY

If any provision of this Privacy Policy is held to be illegal, invalid, or unenforceable under any present or future applicable law - (a) such provision or part thereof shall be fully severable; and (b) the remaining provisions of this Privacy Policy shall remain in full force and effect and shall not be affected by the illegal, invalid, or unenforceable provision, or by its severance here from, to the extent permissible under the applicable law.

RIGHT TO TERMINATE AND SUSPEND
